ection 1241 of the Energy Policy Act (P.L. 109-58, 119 Stat. 594 2005) adds a news section 219 to the Federal Power Act mandating that no later than a year after enactment of section 219, FERC is to establish, by rule, incentive-based (including performance- based) rate treatments for the transmission of electric energy in interstate commerce by public utilities for the purpose of benefiting consumers by ensuring reliability and reducing the costs of delivered power by reducing transmission congestion.
